Limited Warranty

LIMITED WARRANTY

Subject to the terms and conditions herein, NetworkRV expressly warrants all new products, except the SoftStartUp, made by it to be free from manufacturing defects for a period ending on the third (3^rd) anniversary of the date of delivery to an end user of the product (“Purchaser”) or the fifth (5^th) anniversary of the date of NetworkRV’s initial shipment of such product from its facility to its distributor, whichever occurs first (the “Warranty Period”).

For the plug and play product the SoftStartUp, NetworkRV expressly warrants new SoftStartUp products made by it to be free from manufacturing defects for a period ending on the first (1^st) anniversary of the date of delivery to an end user of the product (“Purchaser”) or the second (2^nd) anniversary of the date of NetworkRV’s initial shipment of such product from its facility to its distributor, whichever occurs first (the “Warranty Period”).

The Purchaser must notify NetworkRV of any defect or malfunction in writing delivered by overnight delivery or certified mail and received within the Warranty Period in order to secure repair or replacement of the product or a refund and, if purchased from NetworkRV, the Purchaser must return the product to NetworkRV at Purchaser’s expense so that it is received no later than within one day of the expiration of the Warranty Period.

The remedies of repair, refund or full replacement shall be the sole remedies of the Purchaser, and the sole obligation of NetworkRV, for any warranty claim hereunder, and NetworkRV shall determine which remedy to exercise at its discretion.

NETWORKRV HEREBY DISCLAIMS ALL WARRANTIES NOT EXPRESSLY STATED HEREIN, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT SHALL NETWORKRV NOR ITS COMPONENT SUPPLIERS BE LIABLE FOR ANY DELAY, WORK STOPPAGE, LOSS OF USE OF EQUIPMENT, LOSS OF TIME, INCONVENIENCE, LOSS OF PROFITS, LOSS OF REVENUES, OR ANY INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM OR ATTRIBUTABLE TO ANY DEFECTS IN OR WARRANTY VIOLATIONS OF NETWORKRV PRODUCTS, WHETHER RESULTING FROM NEGLIGENCE (INCLUDING GROSS NEGLIGENCE) OR OTHER TORT, WARRANTY, CONTRACT, INDEMNITY, BREACH OF THE PROMISE TO REPAIR OR REPLACE CONTAINED HEREIN, STRICT LIABILITY OR OTHERWISE.

This Limited Warranty shall be automatically ineffective, void, and of no further force or effect if: (i) the Purchaser or any user damages the product or any related air conditioner, compressor, or other appliances; (ii) the product is modified by any person or entity other than NetworkRV; (iii) the Purchaser or any user fails to use the product as directed; (iv) the Purchaser or any user misuses or abuses the product; (v) the Purchaser or any user submits the product to unreasonable use; or (vi) the Purchaser or any user otherwise uses the Product in a manner other than as intended. Disputes, if any, arising under this warranty shall be resolved solely and exclusively in any federal or state courts sitting in Broward County, Florida. Claims by a Purchaser under this Warranty shall be permitted only if the Purchaser suffers “actual damage.” Actual damage is limited to the cost of the product purchased.

NOTWITHSTANDING ANYTHING IN THIS WARRANTY TO THE CONTRARY, THE MAXIMUM LIABILITY, IF ANY, OF NETWORKRV AND ITS COMPONENT SUPPLIERS FOR ALL DAMAGES RESULTING FROM OR ATTRIBUTABLE TO ANY DEFECTS IN OR WARRANTY VIOLATIONS OF NETWORKRV PRODUCTS SHALL NOT EXCEED THE PRICE OF THE PARTICULAR DEFECTIVE PRODUCT.
